Aptauja tiesnešiem: Lietu sarežģītības noteikšana   Cienījamie tiesneši! Pamatojoties uz Latvijas un Eiropas Padomes Komisijas Tiesu efektivitātei (CEPEJ) sadarbības projektu tiesu darba efektivizācijai, 2020. gada jūnijā izveidota Tiesu efektivitātes darba grupa, kurā darbojas pirmās un apelācijas instances tiesas no visiem Latvijas reģioniem, kā arī pārstāvji no Augstākās tiesas un Tieslietu ministrijas. Viens no darba grupas uzdevumiem ir lietu sarežģītības pakāpes noteikšana, kura mērķis ir izlīdzināt tiesnešu un tiesu darba noslodzi, kā arī sakārtot tiesnešu vakanču aizpildīšanas mehānismu un resursu plānošanu tiesās. Tiesu efektivitātes darba grupa ir izstrādājusi aptaujas anketu tiesnešiem ar mērķi noskaidrot vidēji patērējamo laiku lietu izskatīšanai (faktiskais darbs).   Izpētot Eiropas Padomes dalībvalstu praksi “lietu svēršanā”, darba grupa nonāca pie secinājuma, ka lietu sarežģītības pakāpes noteikšanai vēsturiski izveidotās lietu kategorijas nav izmantojamas. Tādējādi, lietu svēršanai darba grupa apvienoja lietas lietu grupās pēc tiesību apakšnozarēm un procesu veidiem civillietās un procesu veidiem krimināllietās. Atbilstoši CEPEJ piedāvātajai metodoloģijai, lietas sarežģītība tiks noteikta proporcionāli vidēji patērētajam laikam (darbietilpība), kas tiks noteikts balstoties uz tiesnešu aptaujas rezultātiem. Ņemot vērā jautājuma nozīmi turpmākai tiesu sistēmas attīstībai un noslodzes plānošanai tiesās, mums ir svarīga katra tiesneša dalība un viedoklis. Atbildes uz anketas jautājumiem ir anonīmas, taču lūdzam norādīt tiesu, kurā strādājiet.
